ADnD.COM General Policy
By opening an account with ADnD.COM, you agree to abide by all
policies of ADnD.COM These policies apply to all users of
ADnD.COM without exception; failure to adhere to the stated
policies may result in termination of the account at the discretion of
ADnD.COM
ADnD.COM reserves the right to change policies, services, and
pricing. Your continued use of an account signifies acceptance of any
and all policies and policy changes, and you may cancel if you do not
agree with changes in policy, service, or pricing.
ADnD.COM reserves the right to refuse to provide service to
anyone.
Disclaimers
ADnD.COM makes no warranties of any kind, whether express or
implied, for the service it is providing. ADnD.COM will not be
held responsible for any damage you suffer from use of an account
or service provided by ADnD.COM, unless otherwise agreed to in writing.
This includes- but is not limited to- equipment damage, failure or
loss of data resulting from delays, non-deliveries, or service
interruptions caused by the company's negligence or your negligence or
misuse.
Privacy
ADnD.COM is committed to preserving the privacy of its
customers and protecting their personal data. ADnD.COM keeps
information about its customers such as names, addresses, telephone
numbers and details about ADnD.COM services used by the customer.
While some of this information may be made available to our immediate
affiliates in the course of providing services our customers have
requested, ADnD.COM will not otherwise disclose any information about
its customers to any other third party without a court order or other
legitimate legal proceedings. In particular ADnD.COM will not
release any customer email addresses to any third party.
Acceptable Use Policy
Any prohibited or illegal activity that affects ADnD.COM, its
agents, equipment or customers is punishable to the full extent of the
law, and ADnD.COM will hold you responsible for any damage
caused by your actions, whether intentional or unintentional. You are
strictly prohibited from using your account other than as outlined in
this Acceptable Use Policy and ADnD.COM will fully co-operate
with any and all Law enforcment and other investigative agencies to
ensure that you will be prosecuted to the full extent of the law if
you do so illegally (see Enforcement section). ADnD.COM makes no
exceptions in enforcing this policy.
ADnD.COM, functions as a common carrier; our standard policy is
to not monitor or interrupt our users' activities, exert editorial
control over their content, or censor them or their content. To
protect the interests of ADnD.COM and in the best interests of
our customers, exceptions to this policy may be made under certain
specific circumstances including but not limited to the following:
Illegal activities: The law requires ADnD.COM
to report any criminal activity that it becomes aware of to the
appropriate authorities. It is the responsibility of the account owner
to be familiar with current laws and regulations.
Email: Email accounts are for personal or business
correspondence only. Unsolicited Commercial Email (otherwise known as
UCE - or spam) is strictly prohibited and violators will have their
accounts terminated immediately. Sending unsolicited email to one or
more addresses regardless of how the addresses were obtained may be
considered spamming and is grounds for account termination. Use of a
ADnD.COM address or any address of a domain hosted by ADnD.COM
as a return address for replies to spam is similarly prohibited.
ADnD.COM may at its discretion employ filtering techniques to
block inbound email from known sources of spam and email abuse, and
may also filter incoming email for known viruses.
Chat: The IRC chat server is provided as a service for
the use of all, and all users must familiarise themselves with, and abide
by, the rules that are posted from time to time on this website, and
within the server messages.
ADnD.COM may at its discretion employ Administrators, and IRC Opers to
act as helpers and enforcers. Whilst such people will act with the full
authority and backing of ADnD.COM. Any views expressed by them that are
not also published on the website, or in the server messages, are not necessarily
the views of ADnD.COM or any of it's proprietors.
At no time will ADnD.COM tolerate any of the following abuses to the
chat system by any members, or other users of the system.
- Users will immediately dessist from attempting to contact or follow
around the channels any other user that has expressed a desire to
discontinue contact with that user. Failure to do so may
constitute an offence in some jurisdictions.
- Users will ensure at all times that their activities remain within
reasonable bounds of common decency. This is not an adult themed
server, and whilst ADnD.COM can hold no responsibility for the subject
matter or content of any chat activity, we will take action if we deem
your activities to constitute a moral or other threat to any minors
that may be an inadvertent audience. Be aware that exposing a minor
to moral danger is an offence in most jurisdictions.
- The Opers act at all times with the full authority of ADnD.COM and
any rulings given are final and must be obeyed.
- Users will not employ scripts that contain Trojans, or Backdoors.
Nor will they employ scripts that are designed to cause distress to
other users, or the server. ADnD.COM reserves the right to refuse
access to such scripts should they be detected.
- Users will not connect to the chat server using an open proxy.
Connecting to the chat server is implicit acceptance of this rule and
ADnD.COM uses a port scanner only for the purpose of determining
whether or not a user is employing such a proxy.
- Opers are not here to help police Chat Rooms. We feel that there are
sufficient tools within the Pseudo Clients NickServ, and ChanServ to
adequately protect your rooms. However they can be called upon to
assist with any other aspect of the Chat server, or with any abuse of
the server policy.
- Users will not set up bots or rooms for the purposes of distributing
Warez, MP3s, Porn, or any copyrighted material without the author's written
permission.
- ADnD.COM reserve the right to terminate without notice, the
connection of any client in breach of this AUP.
Network abuse: Use of ADnD.COM accounts or
services for orchestration of or participation in any abuse of the
ADnD.COM or any other network, system or service is expressly
forbidden and is grounds for account termination and possible legal
action. ADnD.COM retains at all times the right to determine
what constitutes network abuse. Examples include but are not limited
to:

Attempts to hack the ADnD.COM network or any other network or systems

Port scanning

Use of 'cracking' software or techniques

Intentional dissemination of viruses

Intentional provocation of attacks on the ADnD.COM
network or any other network

Flooding ADnD.COM or any other network with traffic for the
purpose of disrupting service

Mail bombing
ADnD.COM customers must also comply with the acceptable use
policies of our upstream providers,
Sonic.net, (http://www.sonic.net), UUNET (http://www.uu.net) and Cable and Wireless ( http://www.cw.com)
Access to content: ADnD.COM functions as a
common carrier and does not censor. Material can be found on the
Internet or in Usenet news groups, etc., that some viewers may find
objectionable; ADnD.COM is not responsible for any content
available via ADnD.COM accounts or services. Any limitation
of access
to content is at all times the responsibility of the account holder
and ADnD.COM shall not be held responsible for access to
material that an account holder deems inappropriate. We suggest that minors be supervised.
Use of copyrighted material: ADnD.COM is
obligated to comply with the Digital Millennium Copyright Act of 1998
(DMCA). All web pages are subject to copyright law, and members are
responsible for the content in their file space. Use of the World Wide
Web, FTP, Newsgroups,IRC or any other services provided by ADnD.COM
to transfer copyrighted material in violation of applicable laws is
prohibited and may result in termination of your ADnD.COM account.
Ownership of submitted material:
All content submitted to ADnD.com shall be under the understanding that
any and all rights of ownership is assumed to be possessed by the submitter,
or else within the public domain.
Any original content and all rights pertaining thereto shall
be irrevocably passed to ADnD.com and under no circumstances shall anyone
submit content that they have no rights to.
ADnD.com shall seek immediate compensation under current laws for any costs
incurred due to false or fraudulent submissions.
In return for the above transfer of rights ADnD.com shall, by dint
of reason guarantee that no use shall be made of submitted content for
commercial purposes, without the prior consent of the submitter.
This shall in no wise limit the non-commercial use of such submitted
content.
ADnD.com in accepting rights to submitted material do so
on the understanding that the originator shall still possess all rights
to their material, and where such rights do not hinder
ADnD.com's use of such material, ADnD.com shall not contest the
originator's use of such material for whatever purpose the originator may deem fit.
Accountability
The owner of any type of ADnD.COM account or service will be
held responsible for any abuse of that account or service, regardless
of whether the owner was the actual initiator of the abuse. This
includes for example but is not limited to: abuse of an email account
or dialup add-on which is part of a customer's account but which is
used by a third party or abuse of a colocated server or colocation
services by a third party, with or without the account owner's
permission.
Enforcement and remedy:
Violation of any terms set forth in this Acceptable Use Policy may
result in one or more of the following, at the discretion of
ADnD.COM:

Issuance of a warning

Temporary suspension of service
-
Billing to defray administrative costs incurred
-
Termination of your services, account or accounts
-
Seeking the co-operation of your service providers, or your ISP's
upstream providers to terminate service to you or your ISP,
using the standard mechanisms for such as provided by all major ISPs.

Legal action
If any activities or security problems involving a ADnD.COM account
or ADnD.COM customer's services cause network outages, the owner of
the account or service will be billed for network down-time. In
instances where it is necessary to terminate a customer's account for
violation of the terms set forth in this Acceptable Use Policy, an
administrative disconnect fee may be applied.
ADnD.COM will normally attempt to contact any user in violation
of this Acceptable Use Policy before taking action, but depending on
the circumstances or the severity of the violation action may be taken
without prior notification. In this case, the user will be notified as
soon as it is practicable.
No limitation
This acceptable use policy in no way limits the rights and remedies of
ADnD.COM At its discretion ADnD.COM may take other
actions it deems necessary to protect the integrity of its or other's
networks or to recover the costs of operation as pertain to
identifying and removing violators of this acceptable use policy.
Advertising On ADnD.COM
ADnD.COM Is a banner free site, we do not want to have banners on
our site. We do have site buttons on our side bar, if you wish to
have your site added to our sidebar please e-mail sales@adnd.com
include an image of your button and the URL to your site. We will
take a look at your site and if it fits the theme of ADnD.COM we
will add it. We do require that you return the favor by adding our
button to your site.
